1.1. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "Teacher") and Quinfer ("we," "us," or "our"). These Terms govern your access to and use of the Quinfer website, services, and AI-powered educational tools (collectively, the "Service").
1.2. By registering for an account or using any portion of the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a school, district, or other legal entity, you represent that you have the authority to bind such entity to these Terms.
2. Description of Service
2.1. Quinfer provides software-as-a-service educational tools designed to facilitate the creation and analysis of classroom assessments. The Service utilizes proprietary algorithms and third-party generative AI technologies, including Google Gemini.
2.2. Accuracy of AI Content: You acknowledge that generative AI may produce inaccurate or biased information. It is your sole responsibility as an educator to review, verify, and finalize all AI-generated questions, answers, and teaching plans before distributing them to students.
3. User Accounts and Security
3.1. Registration is required to access primary features. You must provide accurate and complete information during the registration process via Google Authentication.
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Intellectual Property Rights
4.1. User Content: You retain all right, title, and interest in and to the educational content, instructions, and curriculum data you provide to the Service. You grant Quinfer a non-exclusive, worldwide, royalty-free license to process this data solely for the purpose of providing and improving the Service.
4.2. Quinfer Property: All rights, title, and interest in and to the Service, including the user interface, design, software, and AI integration logic, are and will remain the exclusive property of Quinfer and its licensors.
5. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any local, state, or federal laws.
- Attempt to reverse engineer, decompile, or extract the source code of the Service.
- Interfere with the operation of the Service or any user's enjoyment of the Service.
- Submit content that is defamatory, obscene, or infringing upon third-party intellectual property rights.
6. Limitation of Liability
6.1. The Service is provided on an "as is" and "as available" basis. Quinfer disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
6.2. In no event shall Quinfer be liable for any indirect, incidental, special, or consequential damages arising out of the use of or inability to use the Service, even if advised of the possibility of such damages.
